SB3's Impact on the Texas Hemp Industry

As some of you may have heard, after passing through Congress last week, Texas Senate Bill 3 (SB3) is now awaiting Texas Governor’s signature or veto. We know many of you have questions about what this could mean for the future of hemp-derived wellness in the lone star state. As the Business Manager of Hemp for Health by Jammin Canna, I want to take a moment to share where we stand and how we will be moving forward together.

The mission of our founder, Dr Garth Vaz, has always been rooted in offering safe, effective, reliable physician-formulated cannabinoid products that bring relief, balance, and support to people here in Texas, but also across the country. That commitment remains the same today, and we do not see this changing.

We are closely monitoring the legal developments surrounding SB3. The bill, in its current form, proposes sweeping restrictions on cannabinoids, allowing only CBD and CBG to be sold legally in Texas. While this would be a significant limitation for our industry, we are encouraged that the vast majority of our product line already meets this criteria. The only exception involves a few products that contain legally permissible amounts of Delta-9 THC (no more than 0.3% by dry weight). They remain fully legal today.

What does concern us, and should concern all small businesses and consumers alike, are the proposed licensing and fee increases for the hemp industry. SB3 would impose burdensome costs: $10,000 for initial registration fees, $20,000 in annual fees per retail location, and a $500 fee for each individual product formulation. These numbers are not just high; they are prohibitive. If left unchanged, these measures could force thousands of hemp businesses to shutter their doors and leave countless Texans without access to the holistic support they depend on for sleep, relaxation, and relief.

We believe in a Texas that supports wellness, not one that prices it out of reach of most citizens. We sincerely hope that before this bill is finalized, legislators will consider the real-life impact on families, veterans, caretakers, and patients across our state. We have seen and keep seeing daily the positive impacts that cannabinoids have in the lives of our fellow Texans. We can only hope that these benefits are expanded rather than contracted.
